The work describes constitutional issues considered by the
United States Supreme Court over the past 200 years. Judicial
power has been exercised in the following types of situations:

- disputes between citizens of different states

- appellate jurisdiction of law and fact

- the 14th amendment requiring that no state should enforce
laws abridging the rights of citizens nor deny equal
protection under the laws

- the Supreme Court may balance or weigh state powers as against
individual rights

- strict scrutiny utilizes a rational basis or relationship test

- important criteria include whether or not an important
government objective is served or the issue at bar is
substantially encompassed by the governmental objective

- there is a right to sue when injured by a private person
in the common law

- there is an implied constitutional right of action

- federal law prohibits discrimination on the basis of age,
medical condition and physical handicap according to the
American Disabilities Act of 1990.

This work will appeal to a very wide constituency of legal
scholars, American History enthusiasts and others in academia.

The bulk of A Practical Companion to the Constitution is in dictionary form and provides throrough but concise accessible explanations of the key concepts and terms of art of constitutional analysis. Each entry is also cross-referenced with other related concepts and definitions to aid the reader in fully understanding the concepts discussed. Professor Lieberman also places each entry into a historical context so that the reader may trace the development of doctrines and concepts and understand not only where a doctrine originated but where the state of the law or doctrine stands today. For example, under the entry for "Incorporation Doctrine," Professor Lieberman provides us with a brief explanation of the concept, and then traces the concept through its history and application. At the end of the entry, we find a list of which amendments have been incorporated onto the states, the rights implicated in the incorporation, and the year the amendment was incorporated. Indeed, I was most impressed with how Professor Lieberman has throughout the book explained the abstract concepts of Fourteenth Amendment analysis into easily understandable terms without oversimplifying or doing violence to the concepts. Other sections of the book provide summaries of the cannons of constitutional interpretation so that the reader has a basic understanding of the tools of textual interpretation. Finally, Professor Lieberman provides a thorough table of cases and brief biographical sketches of the justices who have served on the Supreme Court. I give this reference book my highest recommendation. It is a must for law students. It is an excellent resource for lawyers looking for the vocabulary to explain in accessible terms the abstractions of constitutional analysis. It is invaluable for the non-lawyer seeking to understand better the constitution.

Professor Lieberman teaches Constitutional Law at New York Law School. I was privileged to study under him in 1998. He is an immensely knowledgeable man with an unmatched talent for clarity of communication. I am pleased to be able to recommend this book to all readers. For further insight regarding our highest court, I also recommend New York Law School's Dean Harry H. Wellington's very fine book, Interpreting the Constitution: The Supreme Court and the Process of Adjudication.

Most people do not realize that jury consultation was an outgrowth of the 1970s antiwar movement, created to assist in the defense of political activists such as the Harrisburg Seven and the Indians at Wounded Knee. The field has expanded far beyond its progressive roots, to the point that it may be exacerbating the inequities in a system in which money buys justice.

Or not.

After all, how scientific are jury selection techniques? And how much difference does even the best consultant make to the bottom line, that is, the outcome of a trial?

That's the topic of this encyclopedic tome. The book catalogs both the social science literature and attorney how-to manuals. It systematically addresses each of the many demographic and attitudinal factors considered by trial attorneys in challenging individual jurors. We learn that many of these factors turn out to be more mythology than fact, and attorneys don't do much better than chance in detecting jurors who are likely to be biased against their client. We are also treated to an interesting discussion of nonverbal signifiers of bias, another area in which both attorneys and jury consultants may fall short.

I've always felt that jury selection plays only a small role in the outcome of a case. As a former legal affairs reporter, I remember that we members of the press corps could usually predict the outcome of a case we were covering, based on the strength of the evidence alone. Authors Lieberman and Sales concede this point, saying that demographic and personality variables together account for less than 10% to 15% of the variance in jury verdicts. Jury consultation is likely to be most helpful in weak cases, they say. But at any rate, they add, it's unlikely to do much harm, except in draining the bank account of the retaining party. It can also be helpful in developing effective themes for trial, and in arguing for a change of venue due to prejudicial publicity.

Besides the little problem of evidence, another problem with focusing on potential bias among jurors is that they do not render verdicts. Rather, an entire jury renders a verdict, usually after careful and exhaustive deliberation. I had that understanding driven home recently, when I had the great fortune to get to serve on a jury and experience its group dynamics up close. As social scientists have long known, groups do not always behave in a manner predictable by their individual components. This too is a point acknowledged by Sales and Lieberman.

This is a balanced, organized, and well written look at a complex topic. Although it is dense and dry, I highly recommend it to attorneys, social scientists, and anyone else interested in jurors and the jury system.

    Even though this book is 17 years old, it remains in the first rank. More extensive than Steven Stark's, more engaging than Garner's, Goldstein and Lieberman's book is my first choice for any lawyer seeking to become a competent writer. Part III, the longest part of the book is entitled, "Making Your Prose Serviceable," the part one must read. But particularly worthy is the Part following, "Making Your Prose Memorable." Even though few of us will ever attain that goal, it's worth trying. I can't think of another book in the genre suggesting such a lofty purpose. I appreciate having some guidance.

    Are lawyers professional writers? Could a law office benefit by adopting some methods of a book publisher or newspaper office?

    Yes and yes, according to the authors of this excellent book.

    The writing advice is superb, from commas to sentence length and from transitions to editing methods. But the best parts of the book are the suggestions for managing a law office so that it will produce consistent, top-notch written work. The authors recommend using proofreaders, training junior lawyers in editing, and employing someone in the position of copy editor. All great advice that would improve legal writing.

    i first purchased this "intriguing" book when living in chicago where i worked as "foreign patent specialist" and "senior tech writer/editor". When we moved to Las Vegas, after my retirement, I panicked when I realized that I've lost this book. Just open any page and savor the words in this book. Bravo to the authors. I wish I could shake their hands for a well-written and intriguing book.

    As an adult adoptee, I can say I needed this book when I was younger. The title is deceiving. It tackles all the issues adoptees and even foster kids can relate to. I wish my parents had done these ceremonies with me. Some of them would have helped a lot. The ones around fear, loss, transitions, and self-esteem would have been especially helpful. Get this for your family today -- don't waste another minute thinking about it.

    I have used suggestions in this book many times when issues came up with my daughter, and even used ideas here to come up with some of my own. The ceremonies were fun, easy to adapt and effective ways to raise issues for discussion. They were suprisingly effective at getting us unstuck so we could move on.

    I have recommended the book to several parents, both adoptive and biological.

    This book shows families how to honor and cherish simple and complex acts of every day life. The authors lead readers through real life situations with compassion, knowledge, empathy and personal stories. It's an educational read for potential parents of adopted children and a must read for those who have already welcomed children into their homes.

    I bought this book because a friend suggested it. It sounded like a lot of fluff.

    It turned out to be a lifesaver!

    There were times I was at the end of my rope and I found a way to turn a rough situation around because of this book.

    During calm periods I used other ideas to teach or enhance self-esteem in my two children.

    Do yourself a favor and buy this sooner rather than later. I wish I had. It is a jewel.

Understanding the Teacher Union Contract explores the implications of this collective-bargaining revolution in education. Through detailed examination Lieberman shows how the kinds of provisions typically found in teacher union contracts affect the educational workplace and education reform, and how they might be revised to the benefit of students, parents, and the public.

      Lieberman begins with the respective roles of school district management and teacher unions. Unlike managers in the private sector, school district officials are part of a government agency that is legally responsible for operating public schools in the public interest. They must balance the interests of employees with the needs of students, taxpayers, and parents, as well as with district educational goals. Teacher unions' primary objectives are to enhance employee welfare and to promote the union as an effective organization. Unions must balance the differing needs of various groups within their membership-for example, by resolving tensions between older teachers who want improved retirement benefits and younger teachers who might prefer more rapid salary increases.

      Lieberman shows how competing union and management goals play out in collective bargaining and are embodied in teacher union contracts. He argues that by developing an understanding of teacher unions, their role, and their needs, district officials and school board members can bargain more effectively and develop a productive ongoing relationship with unions. This highly readable book will be of interest not only to school administrators and board members but also to teacher representatives, parents, taxpayers, and members of the media who report on education.

      If you wondered what was wrong in government schooling, the union contract is a good place to find answers. Teacher unions often control both sides of the bargaining table by influencing school board elections and policy making. Management (encouraged by bad court decisions) has given away its rights to fire poor teachers, to pay on basis of performance, and to hold teachers responsible for results. School boards sign contracts that prohibit them to contract out failing schools to private management, to create charter schools without union approval, or to issue vouchers so children in failing schools can select a private alternative to government-operated schooling.

      This is a scholarly book that presents facts without a chip on its shoulder against unions. But the reader may question in the end why as a society we would place monopoly power in the hands of the National Education Association and its state and local affiliates. We certainly were not considering the welfare of our children in so doing.

      This is a poor excuse for a writing book, let along a Legal Writing guide. This information in this book is just barely beyond common sence and provides little practical advise for legal publications, whether academic or professional. However, many law schools seem to require their first-year students to subject themselves to the pain of reading part, if not all of this poor excuse for a teaching instrument. Personally, I had to read two chapters; the prof spend 20 minutes on the material, and even admitted the book has little to offer. Yet the book was on HER booklist as a required title. I smell a rat...save yourself a little money and buy this book used, then use the money you saved for a decent dinner or a few drinks during finals week.

      This is one of the worst writing books on the market. The examples are elementary and poorly written and the style of legal writing is one you would never use in the work place. I actually feel less intelligent after reading this book and hope I can erase all I read from my mind. For a much better legal writing book, try Writing and Analysis in the Law by Shapo et al.
